The victim was survived by his adult children. The defendant’s insurance company rejected plaintiff’s claims for years, offering only $30,000 on the eve of trial. Defendant’s claimed that temperature of the water was reasonable, that the victim’s actions caused his burns, and that he died from unrelated conditions which preexisted the accident. All of those claims were successfully refuted at trial which led the defendant’s insurance company to offer near policy limits to settle this case before verdict.
