  • What do I do after an accident?
    • If you are able to, one of the first things you should do after an accident is try to collect as much information as you can. This means collecting contact information for witnesses and others involved in your accident, as well as taking pictures of the accident. You should also seek medical attention, even if you are unsure of the extent of your injuries, as you may not experience the effects of an injury until days or weeks afterwards. You should contact a personal injury attorney who can help on your case.  It is important not to speak to insurance companies before you have had a chance to speak to an attorney.
  • How do I know if I have a case?
    • A criteria for determining whether an accident may result in a lawsuit is whether the accident was caused by someone’s negligence. This means they either did something they were not supposed to do, or failed to do something they were supposed to do, resulting in an accident.
  • How long do I have to file a personal injury case? 
    • Most types of personal injury cases must be filed within three years of the accident. However, this may vary depending on the cause of your personal injury, so you should seek legal counsel as soon as possible after your accident.
  • What if I had a pre-existing condition?
    • Having a pre-existing condition does not prevent you from suing for a personal injury. Personal injury lawsuits are intended to compensate you for harm you suffered due to others’ misconduct, not to punish you for having a medical condition that makes you more vulnerable to harm.
  • If a loved one passed away in an accident, can I file a personal injury case on their behalf? 
    • Yes, if you are their next of kin. Typically, this means you must be an immediate family member, such as a spouse, parent, child, or sibling.
  • If I was burned in a fire does that count as a personal injury case?
    • Depending on the cause of the fire, a burn may qualify you for compensation in a personal injury case.
  • Do I contact a lawyer about a medical malpractice problem or the doctor/hospital?

    • Yes, it is likely that this would be a good cause for a personal injury case. However, each case is unique, and it is difficult to assess the strength of your case before you consult with an attorney.
  • If I fall and am injured on someone else’s property (private or public) does that count as a personal injury case? 
    • Yes, if you slip or trip and fall on someone else’s property, that can be a personal injury case.

    • You can sue a municipality, such as a village, town or city, in much the same way you would sue any other plaintiff.  However the time limits to do so are significantly shorter and require that a notice of claim or a notice of intention to make a claim be filed prior to commencing a lawsuit.
  • What if someone assaults me, or intentionally injures me? 
    • Yes, you can sue someone for intentionally injuring you, even if they currently have a criminal case against them for the same offense.
