Construction Accident due to Roof Collapse

A 52-year-old construction worker, who specialized in ironworking, was killed on, February 24, 2015, when steel beams intended for the new environmentally-friendly roof at Brooklyn's Barclays Center fell off and stuck him.

According to reports, the worker was part of a team installing the vegetative green roofing near the Atlantic Avenue side of the arena around 1 p.m. when four beams, also called joists, rolled off a work truck before they were fastened to a crane to hoist them into place.

The victim was pronounced dead at the scene, according to police sources. The Department of Buildings and NYPD were investigating the accident, but as of the date of this entry, no violations have been issued.

The death of a loved one is a difficult and traumatic experience that oftentimes leaves more questions than answers. In the unfortunate event of construction work-related death, there are usually multiple parties involved in a construction project, thus any one of them could be at fault for the accident that caused the death.

If your loved one's employer is at fault for causing the construction accident that led to wrongful death, you may be entitled to compensation from your loved one's workers' compensation benefits. The receipt of workers' compensation benefits will generally bar a lawsuit against an employer for liability. However, even if you are able to recover these benefits, you can still pursue an action against a third party, like the owner of the property, the general contractor, or a manufacturer of a defective product. In most circumstances, the compensation associated with such lawsuits is much greater than your loved one's death Workers' Compensation benefits.
